Court of Protection decisions
Northumbria Healthcare NHS Foundation Trust v HX and Others [2024] EWCOP 52 (T3); [2024] Med LR 568
The judges sitting in the Court of Protection have some very difficult decisions to make, involving both legal rules and ethical principles and although each case must be decided on its unique facts, decision-makers are assisted by guidelines of more general application which can be extracted from the leading cases. The case outlined here is an example of such a case, which Cusworth J described as "a truly sad case, but one where in the end I am satisfied that the outcome is clear".
