Any Coastal State in ice-covered areas have the right under Article 234 of UNCLOS to adopt and enforce non-discriminatory laws and regulations for the prevention, reduction and control of marine pollution from vessels in ice-covered areas within the limits of the exclusive economic zone beyond their territorial jurisdiction, for the safety of navigation and where marine pollution could cause major harm to or irreversible disturbance to the pristine environment of the boreal wilderness. In fact, this article was actually adopted as a result of pressure by the Canadian government.1 Naturally, Canada appreciates that environmental interests are not the only ones at stake; Canadian business has real opportunities, as well.
