Discipline and Dismissal
The Master has always held powers of managing the employment of seafarers. The Maritime Labour Convention has diluted such powers, following the position in UK employment law that, in all cases within its influence, the ultimate power of dismissal rests with the employer, leaving the Master with the power simply to dismiss them from the ship. That being said, the Master has a relationship with the employer that makes them their employee, representative and agent, so if the employer delegates its power to the Master to terminate the seafarer's employment, the Master will do so, but the employer will still remain liable under the Seafarer's Employment Agreement and, indeed, the English laws of unfair dismissal under Part X of the Employment Rights Act 1996.
