12.1 Adjudication is an interim dispute resolution procedure by which the parties to a construction contract are provided with a unilateral right to refer a dispute to an independent determiner who, having received a submission from each party, will make a final binding decision. It provides an interim dispute resolution process by which, for statutory adjudication at least, cannot be contracted out of. The adjudicator’s decision is binding on the parties, unless or until the dispute is determined by litigation, arbitration or by agreement.1
