High Court grapples with quantum in motor accident claim

XP v Compensa Towarzystwo SA and Bejger [2016] Med LR 570, [2016] EWHC 1728 (QB), 13 July 2016

The High Court had to tackle complicated issues of quantum and causation in this case. The claimant was a 40-year-old Polish national who had suffered two car accidents – one in April 2011 in Poland while she was pregnant, and another in March 2013 on the M4. By 2015, she was suffering from depression, had no permanent job, and had not had a relationship since 2011. Liability for her injuries was not disputed for either of the accidents, but there was difficulty apportioning the special damages.
