DISPUTE RESOLUTION
INTRODUCTION
9.1
Disputes, while not necessarily inevitable, are not uncommon in any major construction or engineering project. Unless addressed in the underlying contract, the parties will have to rely on the procedures available to them outside the contract to resolve a dispute, which may, in most instances, mean litigation in the local courts. However, litigation will usually not be the parties’ favoured option. It is therefore essential that the contract provides for adequate and appropriate procedures for resolving disputes.
