5 POLICY CONSTRUCTION: LAW VERSUS FOS

PRECEDENT

5.1 In the interests of certainty, precedent will be followed by a court where the meaning of a term has been established by judicial decision, unless the wording or context in question can be distinguished. As Waller LJ said in Ramco (UK) Ltd v International Insurance Co of Hannover Ltd 1:
