Obligations of the Carrier
Article 11. Carriage and delivery of the goods
NOTES
[11-01]
The general obligations of the carrier1 in respect of the goods are outlined in Article 11. The duties are: to carry the goods2 to the place of destination3 and deliver4 them to the consignee.5 The performance of these duties is to be made subject to the Rotterdam Rules and in accordance with the contract of carriage. This statement of the obligations that are considered to be the basis of the contract of carriage is new to, and does not appear in, any of the predecessor Conventions, either the Hague, Hague-Visby or Hamburg Rules. The reference to the terms of the contract of carriage is presumably related only to issues that are not conclusively regulated under the Rotterdam Rules. The obligations imposed raise a number of issues which so far have mostly been resolved under national law.
