As mentioned briefly in Chapter 1 above, RSC Order 72 was amongst the old rules repealed when the Civil Procedure Rules came into force on 26 April 1999. At that stage, and somewhat oddly,1it was not directly replaced by a Rule, but by a Practice Direction. The position was rectified in 2001 with the coming into force of a new CPR Part 58, entitled “Commercial Court”. Other, related, Rules that came into force at or around the same time were Part 59 (Mercantile Courts), Part 61 (Admiralty Claims) and Part 62 (Arbitration Claims). Each, like other Rules, is supplemented by a Practice Direction. CPR Part 62 and its practice direction are discussed in detail in Chapter 10, which deals with the Commercial Court and arbitrations.
