THE POLICY WORDING

The detailed terms of the insurance cover will usually be set out in a document that is as the policy wording. Where the broker is responsible for drafting the wording the broker plays an important role in ensuring it is clear and unambiguous and accurately reflects the parties’ intentions. Many insurers have their own wordings, but the broker may have responsibility for compiling the agreed standard wordings, endorsements and specially agreed schedules. The broker will also owe a duty to the client to ensure that the wording meets the client’s needs and, insofar as possible in the context of commercial negotiations, that the wording is in the client’s interests.
