1. Defining the scope of the chapter

4.1 This chapter is for lawyers involved with professional negligence claims. It is designed to provide a practical guide to issues arising in this field of litigation. It is based on the practical experience of the authors of the chapter over many years of practice. It is assumed that those reading this chapter will have a working knowledge of the Civil Procedure Rules. The rest of this chapter is divided into the following sections:

Section II covers the pre-action process for commencement of a claim (during and as a result of which the great majority of claims are resolved).
