SUBMISSION AGREEMENTS UNDER THE ARBITRATION ACT 1996

As noted in , the definition of “arbitration agreement” in the Arbitration Act 1996, s 6(1) covers an agreement to refer “present” disputes to arbitration: such an agreement is referred to as a “submission agreement” in this work. An agreement to go to arbitration, made after the dispute in question has arisen, is for most purposes treated by the 1996 Act in the same way as an agreement to refer future disputes to arbitration, although the following points may be noted:
