The legislative framework for international arbitration in India is the Arbitration and Conciliation Act. This Act came into force in 1996 and is based upon the UNCITRAL Model Law. There are, however, some important respects in which this statute varies from the Model Law. For example, whereas the Model Law does not allow for an appeal, section 37 permits appeals on limited grounds: for instance, in respect of awards made by the arbitrators in which they rule upon their own jurisdiction.
