Introduction
The resolution of construction disputes is an expensive exercise in terms of both time and money as well as an enormous drain on emotional and intellectual energy. Although the degree of suffering can to some extent be mitigated by choosing the most appropriate form of dispute resolution – adjudication, mediation, expert determination, arbitration, litigation, etc. – it always involves some degree of pain. Indeed, it has been observed that if construction disputes were a patient they would be declared ‘seriously, if not critically, ill’, and while all commercial parties complain about the problems associated with litigation, it is construction disputes where ‘the disease is most advanced’.1
