Supreme Court clarifies measure of recovery for victims of motor accidents abroad
Moreno v The Motor Insurers’ Bureau [2016] UKSC 52, 3 August 2016
The background to this appeal is that the claimant was hit by a car which was registered in Greece and was being driven by an uninsured driver, whilst she was on holiday in Greece in May 2011. The claimant had sought damages from the UK Motor Insurers’ Bureau (MIB) pursuant to the Sixth Directive (2009/103/EC), which is implemented in English law through The Motor Vehicles (Compulsory Insurance) (Information Centre and Compensation Body) Regulations 2003 (SI 2003 No 37).
